Terms of Use
Last updated 26 September 2026
In short: you can use RAD for your own and your clients' railway projects, but the software stays ours, so don't copy it, reverse engineer it or resell it. Everything RAD produces must be checked by a qualified engineer before anyone relies on it.
1Who we are
RAD, the Railway Alignment Designer ("RAD", "the service"), is the website at radrailway.com and the software that runs on it. It is owned and operated by Moyukh Roy ("we", "us"). These terms are an agreement between you and us.
2Accepting these terms
By creating an account, signing in or otherwise using RAD, you agree to these terms and to our Privacy Policy. If you use RAD for an employer or client, you confirm that you may accept these terms for them, and "you" includes them. If you do not agree, do not use RAD.
3Your account
- You must be at least 18 years old, or use RAD under the supervision of a parent, guardian or institution that accepts these terms.
- Give accurate details and keep your password and sign-in links private. You are responsible for everything done under your account.
- An account is for one person. Do not share your sign-in with others, and do not let several people use one account.
- Tell us at once at moyukh229197@gmail.com if you think someone else has used your account.
4What you may do with RAD
We give you a limited, personal, non-exclusive, non-transferable and revocable licence to use RAD through a web browser to design and assess railway alignments for your own projects or your employer's or clients' projects, as long as you follow these terms and the limits of your plan.
RAD itself stays ours. All rights in the software, its source and compiled code, algorithms, rate catalogues and their compilation, documentation, text, graphics, logos and user interface belong to Moyukh Roy or our licensors and are protected by the Copyright Act, 1957 and other laws. Any right not expressly granted here is reserved.
5What you must not do
Your browser has to download parts of RAD's code to run it. That does not give you any right to that code. You must not, and must not help anyone else to:
- copy, save, mirror, republish or redistribute RAD's code, pages, rate data or documentation, other than the temporary copies your browser makes while you use the service;
- reverse engineer, decompile, disassemble, de-minify or de-obfuscate RAD, except where the law allows this despite a contractual prohibition;
- use RAD, its outputs or its code to build, train or improve a competing product or service;
- sell, rent, sublicense, resell or offer RAD to others as a service, or give access to anyone who has not accepted these terms;
- get around sign-in, plan limits, usage allowances or any other technical control;
- scrape RAD or use bots or scripts to access it, except through features we provide for that purpose;
- overload, probe or attack the service or its providers, or upload anything harmful or unlawful;
- remove or change any copyright, trademark or other notice.
6Your projects and data
You keep ownership of the projects, drawings, files and other material you create or upload ("your content"). You give us permission to store, copy, process and display your content only as needed to run RAD for you and the people you share it with, to back it up, and to keep the service secure.
You are responsible for your content and for having the right to upload it, including any survey, map, land or client data. Do not upload information you are not allowed to share with us or our service providers.
7Engineering outputs need a qualified engineer
RAD produces preliminary designs, checks, quantities, cost estimates, reports and drawings to support engineering work. They are not a substitute for professional judgement.
- Every output must be checked and approved by a suitably qualified engineer against the standards, codes, schedules and site conditions that apply to your project before it is relied on, submitted or built.
- Terrain, map, imagery and other third-party data used by RAD can be incomplete, out of date or inaccurate.
- Rates, cost estimates and quantities are indicative. Schedules of rates, taxes and market prices change, and we do not guarantee that any figure is complete, current or suitable for a tender or sanction.
- Compliance checks cover only the rules RAD implements and the inputs you give it. A passing check does not mean a design complies with every requirement.
8Paid plans
Some features may be offered only on paid plans. When you buy a plan:
- The price, what the plan includes and the billing period are shown before you pay. Prices are in Indian rupees and include or add GST as shown at checkout.
- Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from your account, and the plan stays active until the end of the period you have paid for.
- Payments are processed by our payment provider. We do not see or store your full card or bank details.
- We may change prices for future billing periods. We will tell you at least 14 days before a change applies to you.
- Refunds are covered by our Refunds & cancellation policy.
9Services from other providers
RAD relies on other providers for hosting, sign-in and storage, maps, terrain, place search, voices and the optional assistant. Their availability is outside our control. If you choose to use your own key for an AI provider, your use of that provider is also governed by its terms.
10Changes to the service
We improve RAD often, and we may add, change or remove features. We will try to give notice of changes that significantly reduce a paid plan. We may suspend the service briefly for maintenance or security.
11No warranty
RAD is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including about fitness for a particular purpose, accuracy, or uninterrupted or error-free operation.
12Limits on our liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, contracts, data or goodwill, arising from your use of RAD or its outputs. Our total liability to you for all claims about RAD is limited to the amount you paid us for RAD in the twelve months before the claim, or ₹1,000 if you have paid nothing. Nothing in these terms limits liability that cannot be limited by law.
13Your responsibility to us
You agree to compensate us for any claim, loss or expense arising from your breach of these terms, your content, or your use of RAD's outputs without the independent checks section 7 requires.
14Suspension and closing accounts
You may stop using RAD at any time, and we will close your account and delete its data when you ask. We may suspend or close an account that breaks these terms, puts the service or others at risk, or is required to be closed by law. Where we reasonably can, we will warn you first and let you export your projects.
15Governing law and disputes
These terms are governed by the laws of India. Before starting any formal proceedings, please contact us so we can try to resolve the matter. Any dispute that cannot be resolved will be subject to the exclusive jurisdiction of the courts at Kolkata, West Bengal.
16Changes to these terms
We may update these terms. We will post the new version here with a new date, and tell signed-in users about significant changes before they apply. If you keep using RAD after that, you accept the new terms.
